BJ'S BLOG 03/10/16 "More Jail Time, Less Money"

The Erin Andrews case continues to hold my attention. She was awarded 55 million dollars, with her stalker being ordered to pay half…so, that money is right out the window, because that creep doesn’t have the dough. That takes her down to about 27 million dollars from the Marriott, but they’re intending to argue that amount down as well.
 
There are some fairly knowledgeable sources that seem to think that Erin will end up with about 20 million dollars at best, because it will probably be easier to settle for a smaller amount, rather than getting into a protracted legal battle that could last years. Then, of course, we have the question of legal fees, which can often run between 33 and 40 percent of the final payoff. It’s not clear if Erin will have to pay that amount, but let’s not forget that she’ll probably lose half of her final reward to Uncle Sam, because rewards for these types of damages are taxable.
 
Erin’s stalker only served 2 years and change for his crime; Gawker acted with full knowledge that they were doing something wrong; and the Marriott was negligent in their involvement. Erin certainly deserves justice, but I feel like it’s better for the guilty parties to suffer for their sins than it is for the justice system to solve things by simply paying out a pile of dough. Why is the stalker out of jail? Why isn’t Gawker shut down?
 
Money may provide some sort of restitution, but it won’t ultimately fix the problems that Erin will have to live with for the rest of her life.
